Insomnia Program Terms and Conditions

These terms apply to your enrolment in the Circa Sleep Insomnia Program. We keep a record of the version you accepted at checkout.
Please read sections 4 and 5 before you enrol. Section 4 sets out who this program is not suitable for. Section 5 sets out how to do it safely. For part of the program, the time you spend in bed is matched to the amount you are actually sleeping, so that your nights become more solid. You are not asked to sleep less than you already do. Even so, most people feel sleepier during the day for the first two to three weeks. For most people that is mild and short lived. For a small number of people that extra sleepiness matters, and section 4 explains who should speak to their GP first.
We do not screen, assess or approve anyone before enrolment. The decision about whether this program is right for you is yours, using the information in these terms. If you change your mind, you can ask for a full refund within 21 days (section 8).

1. Who we are and what these terms cover
The Circa Sleep Insomnia Program (the program) is provided by Circa Sleep Pty Ltd trading as Circa Sleep Psychology (ABN 94 678 977 574) of 2/356 Pacific Highway, Lindfield NSW 2070 (Circa Sleep, we, us, our).
These terms are a contract between you and Circa Sleep. They apply from the moment you enrol. By ticking the confirmation boxes at checkout and completing your purchase, you agree to them. If you do not agree to them, do not enrol.

2. What the program is
The program is a structured online education program for adults who have persistent difficulty falling asleep or staying asleep. It teaches the two best evidenced approaches to chronic insomnia: Cognitive Behavioural Therapy for Insomnia (CBT-I) and Acceptance and Commitment Therapy (ACT).
It is delivered as pre-recorded video, written material and worksheets, released on a set schedule. You work through it yourself, at your own pace. The teaching content is the same for everyone and is general health education. It is not written for your circumstances and does not take account of them.
There are two tiers. What you get depends on the one you buy.
- Self-paced. The program materials, and nothing else. There is no individual contact with a psychologist at any point. Nobody reads what you write in the program, and nobody knows how you are going.
- Guided. The same materials, plus written feedback from Dr Amelia Scott, a psychologist registered with the Australian Health Practitioner Regulation Agency, at the milestones listed at checkout. At each milestone you submit a short questionnaire, Dr Scott reads your answers, and she replies in writing within 3 business days.
We want to be accurate about what that feedback is. Written feedback from a registered psychologist, about your own answers, is a psychological service. Dr Scott provides it under the professional obligations that apply to her, including her obligations about consent, records and confidentiality, and she gives it with reasonable care on the basis of what you have chosen to tell us.
It is also limited, deliberately. It covers your program data and how to apply this program's content to your situation. It does not extend beyond that, and section 3 sets out what it is not. If you raise something outside that scope, Dr Scott will say so and point you towards the right kind of help rather than answering it.
Any score reported back to you, including any score from a sleep questionnaire, describes how you answered on the day you answered. It is not a diagnosis.
3. What the program is not
Neither tier is:
- individual therapy, or a course of treatment designed for you;
- an assessment or a diagnosis;
- advice about your particular circumstances, beyond the limited feedback described in section 2;
- monitored. Nobody is watching how you are going. On the guided tier we see your answers only at the milestones, and only once you submit them;
- crisis, emergency or after hours support (see section 11);
- medical advice, or advice about your medication;
- a substitute for advice from your GP, psychologist, psychiatrist, sleep physician or other treating health professional;
- a service for which a Medicare rebate or private health fund benefit is available.
Enrolling does not make Circa Sleep or Dr Scott your treating psychologist. We are not responsible for your care generally, we are not available between milestones or after your access ends, and we do not take over from or coordinate with the practitioners who are treating you. If you want an assessment, a diagnosis, or treatment for insomnia or anything else, see your GP, or book an individual consultation, which is a separate service on separate terms.
Do not stop, start or change any prescribed medication because of anything in this program. Talk to the doctor who prescribed it.
We cannot promise a result. Insomnia responds well to these methods for many people. People respond differently, and we do not promise any particular outcome, including any improvement in your sleep.
The program is designed for people in Australia and refers to Australian services and Australian emergency numbers. We do not represent that it is appropriate or available anywhere else.
4. Is this program right for you?
The program is for adults who struggle to fall asleep or stay asleep at least a few nights a week, have done so for a while, and are finding it affects their days, their mood, or their life.
Part of the program is a phase usually called bedtime restriction, or sleep restriction. You set a sleep window matched to the amount you are currently sleeping, and widen it as your sleep consolidates. The aim is to remove the time you spend lying awake in bed. You are not asked to sleep less than you already do, and the window is widened as soon as your sleep allows. We explain the method, and how to use it thoughtfully and safely, before you start it. Most people notice more daytime sleepiness during the first two to three weeks.
You must be 18 or over to enrol.
Do not enrol if any of the following applies to you, unless your GP or another treating health professional knows about this program and has told you it is appropriate for you:
- you snore loudly, wake gasping or choking, or someone has noticed pauses in your breathing during sleep, and you have not been assessed or treated for sleep apnoea;
- you regularly fall asleep without meaning to during the day;
- you drive long distances, operate machinery, or do other safety critical work as part of your job;
- you have been diagnosed with bipolar disorder;
- you have epilepsy or another seizure disorder;
- you sleepwalk, have night terrors, or physically act out your dreams;
- you have been diagnosed with narcolepsy, restless legs syndrome or another sleep disorder other than insomnia, and it is not currently treated;
- you do night shifts or rotating shift work;
- you are going through a mental health crisis, or you have had recent thoughts of harming yourself.
If you have already discussed CBT-I with your GP, psychologist or sleep specialist, or you were referred to a program like this one, you can go ahead and enrol.
Bedtime restriction is also difficult to apply when your nights are broken by someone else, for example if you are pregnant or caring for an infant. You can still do the program and the education still applies, but it is worth thinking about whether this is the right few weeks for it.

5. Staying safe while you do the program
These are the safety rules for the behavioural parts of the program. They matter more than anything else in this document.
- Expect to feel sleepier at first. Matching your time in bed to your sleep builds up sleep pressure, which is what makes your nights more solid. Most people feel sleepier during the day for the first two to three weeks, and it settles as the window widens. Some people do sleep less in the first week or two before their sleep consolidates.
- Do not drive or operate machinery when you are sleepy. Sleepiness impairs your judgement about how sleepy you are, so do not go by how you feel at the time. If you have any doubt, do not drive.
- Pause if it stops being safe. If you fall asleep without meaning to during the day, or you struggle to stay awake while driving, widen your sleep window straight away, and speak to your GP before you narrow it again.
- Stop and speak to your GP if you notice a lift in mood together with a reduced need for sleep, a seizure, new or worsening low mood, or anything else about the program that worries you.
- If your circumstances change. If something in section 4 becomes true for you while you are enrolled, stop the behavioural parts of the program and speak to your GP or treating health professional before continuing.
- You can stop at any time. Nothing in this program requires you to keep going. Section 8 covers refunds.
6. What you confirm when you enrol
When you tick the confirmation boxes at checkout and complete your purchase, you confirm to us that:
- you are 18 or over, and you are enrolling for yourself and not on behalf of anyone else;
- you have read sections 3, 4 and 5;
- to the best of your knowledge none of the circumstances listed in section 4 applies to you, or one or more of them does apply and your GP or another treating health professional has told you it is appropriate for you to do this program;
- you understand that we do not screen, assess or approve anyone before enrolment, that nobody monitors you while you work through the program, and that the decisions to enrol, to start the behavioural parts, to continue and to stop are yours;
- any information you give us in the program's questionnaires is true and complete to the best of your knowledge.
We rely on these confirmations in giving you access to the program.
If a circumstance in section 4 applies to you and you enrol anyway, we would much rather know. Email us at [email protected], take the refund under section 8, and we will point you towards something more useful. We will not ask you to justify it.
7. Enrolment, price and access
- Price. All prices are in Australian dollars and include GST where applicable. The price is the one shown at checkout at the time you enrol.
- Payment. You may pay in full, or by instalments where an instalment option is offered. If you choose instalments you authorise us to charge each instalment to your nominated payment method on the schedule shown at checkout. Payments are processed by our payment provider; we do not store your full card details.
- Missed instalments. If an instalment fails, we will contact you. If it remains unpaid 14 days after the due date, we may suspend your access until it is paid. We will not charge default interest or collection fees.
- Access. On payment we give you access to the program on our platform for 12 months from the date of purchase. Modules are released progressively on a set schedule rather than all at once, so that the program is worked through in order.
- Upgrading. If you buy the self-paced tier you may upgrade to the guided tier at any time while you have access, by paying the difference in price shown at the time. Milestones that have already passed are not backdated.
- Your account. Access is personal to you. Do not share your login. You are responsible for activity under your account and for keeping your password secure.
- What you need. A device with a current browser and a reliable internet connection. We are not responsible for your equipment or connection.
- Availability. We aim to keep the program available at all times, but it is delivered through a third party platform and may occasionally be unavailable for maintenance or for reasons outside our control. Where an outage materially affects your access, we will extend your access period by at least the length of the outage.
8. Your 21 day refund window
If you decide within 21 days of purchase that the program is not right for you, email us at [email protected] and we will refund you in full.
- You do not need to give a reason.
- It does not matter how much of the program you have worked through.
- If you are paying by instalments, we refund every instalment you have paid and cancel the remaining ones.
- We will process the refund within 5 business days of your request, to the payment method you used.
- Your access to the program ends when the refund is processed. Anything you downloaded remains subject to section 13.
After 21 days we do not offer refunds for change of mind. That does not affect your rights under the Australian Consumer Law, which are set out in section 9.
9. Your rights under Australian Consumer Law
Our services come with guarantees that cannot be excluded under the Australian Consumer Law. For major failures with the service, you are entitled to cancel your service contract with us and to a refund for the unused portion, or to compensation for its reduced value. You are also entitled to be compensated for any other reasonably foreseeable loss or damage. If the failure does not amount to a major failure, you are entitled to have problems with the service rectified in a reasonable time and, if this is not done, to cancel your contract and obtain a refund for the unused portion of the contract.
Nothing in these terms excludes, restricts or modifies any guarantee, right or remedy you have under the Australian Consumer Law or any other law that cannot lawfully be excluded, restricted or modified. If any part of these terms would do so, that part does not apply to you.
10. Our responsibility, and its limits
- What we are responsible for. We will provide the program with due care and skill, and it will be reasonably fit for the purpose described in section 2. Where you have bought the guided tier, the feedback described in section 2 will be given with the care and skill reasonably expected of a registered psychologist working within the scope described there. The safety information in sections 4 and 5 has been prepared with reasonable care and is accurate as at the date of this version.
- What we do not promise. We do not promise any particular outcome, including any improvement in your sleep, mood, energy or functioning. Results differ from person to person and depend on factors we do not control.
- Your decisions. The program is self-guided. You decide whether to enrol, whether and how to apply what it teaches, and when to stop. To the extent permitted by law, we are not responsible for loss or harm arising from a decision you make about your own health, work or driving, or from your enrolling when a circumstance in section 4 applied to you and you did not have the advice described there.
- Information you give us. To the extent permitted by law, we are not responsible for loss or harm arising because information you gave us was inaccurate or incomplete.
- Third parties. We are not responsible for the acts or omissions of your GP or other health professionals, or for third party websites, services or platforms we link to or use, except to the extent the law makes us responsible.
- Consequential loss. Subject to section 9 and to paragraph (h) below, and to the extent permitted by law, we are not liable for indirect or consequential loss, or for loss of profits, income, opportunity, savings or data.
- Cap. Subject to section 9 and to paragraph (h) below, and to the extent permitted by law, our total liability to you for all claims connected with the program is limited to the total amount you have paid us for the program.
- What we never limit. Nothing in these terms limits or excludes our liability where the law does not allow it to be limited or excluded. This includes liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, and under the Australian Consumer Law.
11. If you are in crisis
The program is not crisis support and is not monitored. Nobody at Circa Sleep sees what you write in the program's questionnaires in real time. On the guided tier your answers are read when Dr Scott reviews them, within the response time in section 2, and not when you submit them. Emails to us are read during business hours, Monday to Friday, and we aim to reply within 48 hours on business days. Do not use the program, its questionnaires or email to tell us about an emergency.

12. Your information
We handle your personal information in accordance with the Privacy Act 1988 (Cth), the Australian Privacy Principles and our Privacy Policy.
- What we collect before you buy. Only your name, email address and the information needed to process your payment. We collect no health information before purchase.
- What we collect inside the program. The questionnaires in the program ask about your sleep and your health. That is sensitive health information, and we collect it only with your consent, given at the questionnaire itself. Answering is voluntary and you can leave questions blank.
- What we use it for. To give you a starting point and to let you measure your own progress. On the guided tier, also to prepare the written feedback described in section 2. We also use de-identified information, which can no longer identify you, to evaluate and improve our programs.
- Where it is stored. Our program platform stores data on servers outside Australia, including in the United States.
- Who can see it. Circa Sleep staff with administrative access to the platform. We do not sell your information, and we do not share it with third parties for their marketing.
- How long we keep it. Where you were enrolled in the guided tier and received feedback, your responses and that feedback form part of a health record, and we keep them for at least 7 years from your last contact with us, as our professional obligations require. Self-paced responses are deleted within 12 months of your access ending.
- Marketing. We will only send you marketing emails if you have opted in. You can unsubscribe at any time using the link in any marketing email. Opting out of marketing does not affect the emails we send you about the program you have bought.
- Access, correction and complaints. See section 17 and our Privacy Policy.
13. Program materials and how you may use them
All videos, written material, worksheets, questionnaires and other content in the program are owned by us or licensed to us, and are protected by copyright.
We give you a personal, non-exclusive, non-transferable licence to access and use the materials for your own personal use for as long as you have access. You may download or print material where the platform allows it, for your own use.
You must not copy, record, screen-capture, republish, share, sell, sub-licence or distribute the materials, use them to build or deliver a competing program, or share your login with anyone. This obligation continues after your access ends.
Parts of the program draw on published measures used with attribution, including the Sleep Condition Indicator (Espie et al., 2014). Those measures remain the property of their authors.
14. Suspending or ending access
- You. You can stop using the program at any time. If you are within the 21 day window, section 8 applies. After that, stopping does not entitle you to a refund, subject to section 9.
- Us, for breach. We may suspend or end your access if you materially breach these terms, including by sharing the materials or your login. Where it is reasonable to do so, we will tell you what the problem is and give you a reasonable opportunity to fix it first.
- Us, on safety grounds. If something you tell us gives us genuine concern that continuing is not safe for you, we may end your access and refund you in full. Outside the milestone reviews on the guided tier, we do not monitor for such information and are under no obligation to look for it. If we do end your access on this ground, we will tell you why, and we will suggest where to get proper support.
- Us, on notice. If we withdraw the program, we will give you as much notice as we reasonably can and refund the part of your access period you have not used.
- What survives. Sections 9, 10, 12, 13 and 16 continue to apply after your access ends.
15. Changes to the program and to these terms
We may improve or update the program's content from time to time. We will still deliver a program that is substantially the one described in section 2 and that you paid for.
Your enrolment is governed by the version of these terms you accepted at checkout. If we change these terms, the new version applies to enrolments made after it takes effect. We will not change the terms of your existing enrolment to your disadvantage without telling you first and giving you a reasonable opportunity to end your enrolment and receive a refund of the unused part of your access period.
If the safety information in sections 4 or 5 changes in a way that matters to people already enrolled, we will email you.
16. General
- Governing law. These terms are governed by the laws of New South Wales, Australia. You and we submit to the non-exclusive jurisdiction of the courts of New South Wales and the courts able to hear appeals from them. Nothing in this paragraph prevents you from bringing a claim in a tribunal or forum that the law entitles you to use.
- Severance. If any part of these terms is unenforceable, that part is severed and the rest continues to apply.
- No waiver. If we do not enforce a right straight away, we do not give it up.
- Assignment. You may not transfer your enrolment to anyone else. We may transfer our rights and obligations under these terms to another entity that will continue to provide the program on the same terms, and we will tell you if we do.
- Entire agreement. These terms, together with our Privacy Policy and the description of the program at checkout, are the entire agreement between us about the program. Nothing in this paragraph limits your remedies for anything we have told you that is misleading.
- Electronic communication. You agree that we may give you notices and documents by email to the address you gave us, and that ticking the checkout boxes has the same effect as signing.
